Freddie Mac does not restrict a property based on it’s current zoning, HOWEVER, the Underwriter must determine that the subject property does conform to the local authority’s zoning requirements. Meaning it must be either legal, or legal non-conforming and that the property is being utilized for it’s best and highest use.
EXAMPLE:
Property is zoned for Agriculture, but it is not an operating farm then it’s ok. If it is a working farm then it’s NOT ok.
Freddie Mac WILL NOT accept any property with coastal wetlands, tidelands regulations that prevent the repair or rebuilding of the subject property if damaged or destroyed.
